Due to our range of services and solutions offered/ created at Greer Films we have broken these into areas

we believe relevant to understand and follow. As per your purchase / invoice / deposit - Greer Films will provide you your own Terms & Conditions to keep on file for peace of mind. 
What applies to you and your booking? 

Studio Photography Shoot
Applies to any photography shoot Greer Films conducts in the studio located 5/13 Watt Drive, Robin Hill. 

Our minimum booking is for Headshots ($55) while this can include up to 8hours studio hire & Photographer. If you are booking the studio, please be aware of our Studio Hire Terms & Conditions as this will be relevant to you as well. 

Productions
Applies to all Video, Audio & Photography productions in our studio and exterior to our studio location. This is for larger productions Greer Films is developing for you & will supply you with your video/audio/photos in the coming weeks (from production day 1). Productions require a brief to be developed and agreed upon. 

Studio Hire
Applies to any individual / business / organisation who is hiring the studio for their project / marketing. 
Studio Hire applies to the White Studio (cyclorama studio), GRID Studio (adaptable space) and/or Blue Studio (Audio Studio). Our Terms and Conditions outline the minimum hire rates for these spaces. 

In Studio Photography Shoot Terms & conditions

1. Definitions

It is mutually agreed that the following terms and conditions form an integral part of this contract/invoice and that no variation or modification of this contract shall be effective unless accepted by Bill Atherton trading as Greer Films. (Also called “the Photographer” or “the Photographers”) in writing.

 

2. Agreement and acceptance of terms. All agreements and transaction between Greer Films, and any clients are subject to these terms and conditions. All clients who book a photo shoot session or any other product or service from Greer Films agree from that point forward to be bound by these terms and conditions.

 

3. Display

Greer Films reserve the right for any photograph created during sessions to be displayed in the studio, portfolio, or in any other advertising directly associated with Greer Films, unless the subject expresses a wish for their image to not be displayed. Confidentiality of the client, is paramount.

 

4. Force Majeure

Every effort will be made to carry out the contract but its due performance is subject to alteration or cancellation by Greer Films owing to any cause beyond their control (e.g., acts of God, change in legislation, floods, fire, computer failure, etc). In the unlikely event of total photographic failure or cancellation of this contract by Greer Films, liability shall be limited to a full refund of all monies paid.

 

5. Law

These Terms and Conditions shall be governed and construed in accordance with the Laws New South Wales, Australia.

 

6. Liability

Greer Films shall not be liable for indirect loss or third-party claims occasioned by delay in completing the work or for any loss to our clients arising from delay in transit. Where work is defective for any reason, including negligence, our liability (if any) shall be limited to rectifying such defect.

 

7. License

Greer Films shall be granted artistic license in relation to the poses photographed, the location used and digital retouching. The Photographer’s judgement regarding the locations, poses and number of photographs taken shall deemed to be correct.

 

8. Photographs

All photograph sizes are nominal. Greer Films will provide a pleasing colour balance but cannot guarantee exact colour matching. In the case of part mono/part colour images, the colours used will be subject to the photographer’s artistic interpretation and will be deemed to be correct. All photographs supplied by Greer Films are produced to the highest standards using the best quality materials and latest processing techniques. However, all photographs will, in time, fade. This is particularly true if they are left in bright sunlight and are not behind glass. Greer Films cannot accept any responsibility for this gradual image deterioration. All portraits purchased are presumed to have been received in good condition unless the Client notifies Greer Films in writing of any discrepancy or error within 2 days of receipt.

 

9. Payment

Full payment must be made before any orders placed into production, booking made online are paid in full with card payment. 

Orders are subject to a minimum order of $55 per client. 

 

10. Prices

All services and/or goods are supplied at the current prices ruling at the time of supply and are subject to change without prior notice. Offers and discounts can only be claimed on booking and not retrospectively and new promotions/discounts cannot be claimed against existing bookings. An addition charge is applied to all orders delivered on USB. All prices are inclusive of GST.

 

11. Reprint Orders

All re-orders shall be treated as an extension of this contract. No responsibility for error will be accepted if orders are given in writing. 

 

12. Refund Policy

We will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format. No exception can be made as we cannot be held responsible for individual tastes or exceptions. Once an order has been placed, we will not offer a refund. We may at our discretion allow you to place an order for different products with the same value. This will not affect your statutory rights.

 

13. Retouching

Retouching and artist finishing is available as an optional extra and the final output and finish of any image that is re-touched will be at Greer Films’ discretion. Additional charges may be applied for retouching.

 

14. Storage of Images

Original digital images are kept on an active file for 3 weeks post ordering appointment, after which time they will be deleted unless expressly stated otherwise by Greer Films. All ordered images will be kept for 3 months from date of purchase.

 

15. Privacy Policy

Please refer to our website for further information. You information is kept within Greer Films for invoicing and contact information. If you wish to update, please contact directly to have your details amended.

 

16. Lead times are as follows;

Digital Portfolios – maximum 2 weeks, 

Prints – maximum 3 weeks, 

Wall Art - maximum 5 weeks.

These lead times are an estimate of the time it will take for your order to be ready for collection. Urgent orders are at the discretion of the management.

 

17. Collection and Delivery

All orders are delivered via a download link unless prints have been ordered. Prints are to be collect for Greer Films – 5/13Watt Drive, Robin Hill.

 

18. Booking fee/reservation

If you are unable to keep your reservation with us, please contact the studio on 0435115522/ 0408062933. We take a booking fee of 50% of your package/booking type, to secure your session with us please note that this is non-refundable and can only be transferred to another session if we have been given the correct notice to change your appointment with us. We need 48 hours’ notice to re-arrange your session. Only one reschedule will be allowed with any further rescheduling incurring a further booking fee of 50% of your package/booking type.

PRODUCTION TERMS & CONDITIONS
*Weddings exclusive to the following*

1. Definitions

In these video / photo / audio production terms & conditions, unless the context otherwise requires:
Client means any individual who acquires Greer Films Pty Ltd.’s services wholly or predominately for personal, domestic or commercial use.

Client means any person or entity requesting Greer Films Pty Ltd to provide Services.
Agreed Fee means the fees estimated by Greer Films Pty Ltd in any quotation once accepted by the Client.


Materials means any goods, chattels, items or things, including but not limited to any photographs, documents (whether digital or hard copy), tapes, videos, films, footage, props and equipment provided by the Client to Greer Films Pty Ltd for the purposes of Greer Films Pty Ltd supplying the Services.
 

Raw Footage means master footage recorded by Greer Films Pty Ltd as part of provision of the Services.
Services means video production and/or post production services.
Project means video/ photo / audio production in its entirety.

 

2. Application

These production terms & condition apply to and are incorporated into all contracts, agreements, arrangements, transactions and dealings entered into by Greer Films Pty Ltd with any Client in relation to the provision of Services by Greer Films Pty Ltd. All work carried out by Greer Films Pty Ltd is on the basis that the Client has agreed to these Terms and Conditions

 

3. Venue Location Fees & Permissions

The Client must obtain any necessary consent or permission and pay any fees which may apply for Greer Films Pty Ltd to film / photograph / audio record at a particular venue, location or event.

 

4. Artistic License

The Client acknowledges and agrees that editing an event and the production of finished works may include elements of artistic expression and interpretation. Greer Films Pty Ltd reserves the right to use ‘Artistic License’ in any commissioned works that require editing or the production of finished works. The re-editing of commissioned works is offered as an optional extra by prior arrangement. A quotation for re-editing will be provided by Greer Films Pty Ltd on request.

 

5. Client Acknowledgements

The Client acknowledges and agrees that:
Greer Films Pty Ltd will have a lien on Materials provided by the Client; and No title (including any copyright) in the Services manufactured, produced, duplicated or otherwise provided by Greer Films Pty Ltd will be transferred to the Client until the Client pays all amounts due to Greer Films Pty Ltd in full.
The Client acknowledges and agrees that upon payment of all outstanding invoices due to Greer Films Pty Ltd, the Client is entitled to receive the finished works, but has no entitlement to the working files of Greer Films Pty Ltd.
The Client acknowledges and agrees that the content, views and opinions expressed in the finished works produced for the Client by Greer Films Pty Ltd are solely those of the Client. The finished works are intended to represent the opinion of the Client and in no way reflect the views and opinions of Greer Films Pty Ltd, its employees and subcontractors.
The Client indemnifies and holds Greer Films Pty Ltd harmless from any claims or legal actions related to the content of the Client’s video.

 

6. Client’s Materials

All Materials are used and stored by Greer Films Pty Ltd solely at the Client’s risk and Greer Films Pty Ltd is under no obligation to insure any Materials.
Neither Greer Films Pty Ltd nor any of its officers, crew members, employees, agents or sub-contractors will be liable for any loss, destruction or damage (“Loss”) of the Materials other than loss caused by their negligence but any liability for such loss will be limited to replacement of the Materials;
Greer Films Pty Ltd will not be liable in respect of any Loss of the Materials arising out of the action of any person not employed or engaged by or associated with Greer Films Pty Ltd even though such person is present during and involved with the performance of the Services; and
The Client must retain a master copy of all materials delivered to Greer Films Pty Ltd for the purpose of the Video.

 

7. Project Delays and Liability

Any estimate of the date by which Greer Films Pty Ltd will complete any part of the Services is contingent upon the Client providing complete instructions to Greer Films Pty Ltd and fully cooperating with Greer Films Pty Ltd until Greer Films Pty Ltd has ceased providing Services to the Client.
The Client must appoint a person who has complete authority to provide instructions to Greer Films Pty Ltd and respond to requests for feedback until Greer Films Pty Ltd has ceased providing Services to the Client.
The person appointed must be available to respond to communications from Greer Films Pty Ltd on every day which is a business day in New South Wales.
Greer Films Pty Ltd cannot be held liable for project delays which are caused by lack of communication on behalf of the Client, or an Act of God or equipment failure, or any other reason not directly the fault of Greer Films Pty Ltd.

 

8. Sub-Contracting

Greer Films Pty Ltd reserves the right to sub-contract any Services that Greer Films Pty Ltd has agreed to perform for the Client as it sees fit.

 

9. Talent/Background persons/Staff

If the Client requires talent, staff, background persons or passers-by to be included in the production, then it is the responsibility of the Client to obtain the necessary permissions. Greer Films Pty Ltd cannot be held liable for any prosecution from any person that appears without permission. If re-editing or shooting is required to remove such persons it shall be at the Client’s expense.

Greer Films Pty Ltd will at the request of the Client and if included in the pricing structure, obtain permissions from all persons appearing in the production. Greer Films Pty Ltd can aid in permission forms and sourcing talent at the client’s expense if payment is required.

 

10. Client Undertakings and Warranties

The Client must obtain all necessary permissions and authorities in respect of the use of the Materials which are to be included in the Client’s video. The Client indemnifies Greer Films Pty Ltd from any possible liability for the use of any Client supplied media in the Clients video.

 

11. Recorded Material Ownership

The Raw Footage, video files, audio files, photo files and edited video/audio/photo files including all copyright remain the property of Greer Films Pty Ltd until full payment is made for the Services.
Where Services remain unpaid or in the event that a final agreed payment is not made, Greer Films Pty Ltd reserves the right to withhold all recordings and finished works and use all or portions of the recordings and finished works for display, promotional or commercial purposes.
Copyright in all video, images, audio, lyrics or musical composition included or recorded in the edited video or recorded by equipment used by Greer Films Pty Ltd will remain the property of the author or legal entity owning the copyright.

 

12. Intellectual Property Raw Footage

Greer Films Pty Ltd does not retain intellectual property of the video production and raw footage. Once paid for, all final edits and raw footage become the property of the Client. Greer Films Pty Ltd is permitted to keep raw/edited files for 1 year for the client to refer to if required.

 

13. Intellectual Property Licensed Materials

Where one off license is paid for various materials used in the production, or if the material is from a Greer Films Pty Ltd Subscription supplier, the Client must re license the material and/or obtain permission form Greer Films Pty Ltd or pay for another license if they intend to reuse the materials in another production. Greer Films Pty Ltd will not be held liable for breaches in material copyright caused by the Client.

 

14. Shot Footage

Greer Films Pty Ltd will record the video footage for the project using quality cameras and lighting. If the Client rejects the footage after it has been edited, unless it is an obvious mistake or poor workmanship by Greer Films Pty Ltd, then a full re-shoot and editing costs will apply.

 

15. Special Provisions for Anomalous Footage

Greer Films Pty Ltd reserves the right to retain ownership of any recorded material of an anomalous nature once discovered in post-production. The copyright of such recordings will belong to Greer Films Pty Ltd.
Greer Films Pty Ltd has the right to use edited or unedited video files produced pursuant to these Terms and Conditions for promotional or commercial purposes, unless an alternative arrangement is made between Greer Films Pty Ltd and the Client. The copyright of such segments will belong exclusively to Greer Films Pty Ltd.

 

16. Disposal

Raw Footage, video files, audio files, photo files and edited video/audio/photo files will be retained for up to twelve (12) months only and will then be disposed of, deleted or erased. If at the end of twelve (12) months Services have not been paid for, Greer Films Pty Ltd reserves the right to dispose of all Raw Footage, video files, audio files, edited video/audio/photo files, recorded materials and finished works.

 

17. Raw Footage

The Client may have Raw Footage transferred to their own supplied hard disk, or uploaded as required, the Client must pay Greer Films Pty Ltd an additional fee of $400.00 plus GST from 20GB to 100GB other sizes are by negotiation. If Raw Footage is requested after 1 month from production shoot date, there is an additional $100.00 plus GST fee applied for administration costs. *This is not applicable to any Wedding Footage*

 

18. Failure of Equipment or illness of Greer Films Pty Ltd employees and contractors

Whilst all reasonable care and preparation is taken for videography/photography/audio recording and editing, Greer Films Pty Ltd will not be liable for any compensation except for return of any Deposit paid, should a failure occur in all or any of the electronic equipment used or due to illness of the operators or person(s) employed or engaged by Greer Films Pty Ltd or because of an unforeseen event or any dispute regarding the ownership of recorded materials.

 

19. Right of Refusal or Termination

Greer Films Pty Ltd reserves the right to terminate the provision of Services, if: the videographer/ photographer/ audio crew member, or any person(s) employed or contracted by Greer Films Pty Ltd is placed in a position where there is an actual or apparent risk of injury; or there is a risk that any of the equipment used may be damaged. If Greer Films Pty Ltd terminates the provision of Services, then any Deposit paid by the Client is non-refundable. Greer Films Pty Ltd may seek compensation from the Client for any loss or damage suffered.

 

20. Limitation of Liability

The parties acknowledge that, under applicable State and Commonwealth law, certain clauses, conditions, guarantees and warranties may be implied in these Terms and Conditions and there are rights and remedies conferred on the Client in relation to the provision of goods or of services which cannot be excluded, restricted or modified by agreement (“Non-excludable Rights”).
Except to the extent of Non-excludable Rights, Greer Films Pty Ltd will not be liable for:
Any claim by the Client or any person, including without limitation any claim relating to or arising from all clauses, conditions, guarantees and warranties express or implied, and all rights and remedies conferred on the Client, by statute, the common law, equity, trade, custom, usage or otherwise; and
Any representations, warranties, conditions or agreement made by any agent or representative which are not expressly confirmed by CVP in writing, and the liability of Greer Films Pty Ltd for any such matters is hereby excluded. Where (and to the extent) permitted by law the liability of Greer Films Pty Ltd for a breach of a Non-excludable Right can be limited, Greer Films Pty Ltd’s liability is limited, at Greer Films Pty Ltd’s option, to one of the following:
The supply of the service again; or
Payment for the cost of having the services supplied again.
Notwithstanding any other provision, Greer Films Pty Ltd is in no circumstance (whatever the cause) liable in contract, tort (including without limitation negligence or breach of statutory duty) or otherwise to compensate the Client for:
Any increased costs or expenses;
Any loss of profit, revenue, business, contracts or anticipated savings;
Any loss or expense resulting from a claim by a third party; or
Any special, indirect or consequential injury, loss, damage or expense whatsoever and howsoever arising.

 

21. Force Majeure

If Greer Films Pty Ltd cannot carry out an obligation under the initial agreement either in whole or in part because of anything outside its reasonable control, including without limitation, fire, flood, storm, earthquake, explosion, accident, road or rail closures, rail derailment, wharf delays, war, terrorism, sabotage, epidemic, quarantine restriction, labour dispute or shortage, act or omission of any third person or public authority, then Greer Films Pty Ltd’s obligations under the initial agreement will be suspended for the duration of the event or waived to the extent applicable.

 

22. Legal Costs

The Client will be liable for any legal costs incurred by Greer Films Pty Ltd in the recovery of unpaid invoices on an indemnity basis.

 

23. Privacy

All information received by Greer Films Pty Ltd from the Client, written or otherwise, will be kept confidential. Any private information will not be divulged or distributed to any third party without the Client’s consent.

 

24. Public Broadcast (social media/ Website etc)

Greer Films Pty Ltd retains the right, unless instructed otherwise in writing by the Client, to display Clients videos on the Greer Films Pty Ltd website, YouTube, Vimeo or similar public video broadcast sites. Draft videos will also be published on YouTube or similar sites for the Clients approval but will be published as unlisted and deleted. Client also agrees for Greer Films Pty Ltd to use their video on social media platforms of be featured in an episode of “Rewind Replay” produced by Greer Films Pty Ltd.

 

25. Terms and Conditions Amendment

Greer Films Pty Ltd reserves the right to amend these Terms and Conditions at any time. Amendments will be effective after the Client has been given 7 days written notice with or without acknowledgement from the Client.

 

26. Variations, Approvals and Proofing

Once the client has approved or supplied the Brief/Script/Storyboard, and deposits have been paid, Greer Films Pty Ltd will commence production. After editing Greer Films Pty Ltd will provide the Client with a draft edit of the video/s for feedback and approval via a platform or file(s). The Client must then notify Greer Films Pty Ltd within fourteen (14) days, that the video/s / Photo (s) / Audio Production or part thereof is approved or list all proposed tweaks in once instance. Once the tweaks have been made, Greer Films Pty Ltd will provide the Client with a ‘final draft’ which is to be used solely for the purpose of verifying that the supplied tweaks have been correctly implemented. If they haven't been implemented correctly then Greer Films Pty Ltd will tweak until the Client is satisfied. The Client must notify Greer Films Pty Ltd of any errors in the draft copy within fourteen (14) days. Once the fourteen (14) day review period for both the ‘draft copy’ and ‘final draft copy’ has elapsed without notice from the client, Greer Films Pty Ltd may refuse to make any further tweaks and will issue the final Invoice due within 7 days. The Client acknowledges that some tweaks or changes may not be possible.

 

27. Tweaks

Are minor adjustments to the approved script. A tweak is a slight adjustment to the video/ photo/ audio edit. A tweak could comprise of: removing a picture or piece of video, changing an edit point, change of colour, a minor change in a title. These are usually given at no cost as long as the original approved script/ brief or storyboard is adhered to.

 

28. Changes

Changes are variances from the supplied or agreed script. Changes requested by the Client may be liable to additional charges from Greer Films Pty Ltd.

A Change is: new footage, new titles, new order of edit points, a new voice over and generally anything that is new to the supplied script/brief or story board.

If additional footage is required, additional charges my apply.

 

29. Quotations

Quotations are calculated by estimating how long it will take to provide the Services under typical circumstances and are based on production rate. Two rounds of Client tweaks and/or revisions are included in each quotation.
If the Client instructs Greer Films Pty Ltd that significant changes and/or revisions to the scope of the Services described in a quotation are required then Greer Films Pty Ltd shall be entitled to charge an additional Fees based on their standard post production/editing/or video length rate. Hourly rate for out of scope is $90 plus GST per hour.

 

If the Client abandonees the vision from the approved brief, this can be treated as a “New Production”, restarting the production process and quotation. The Deposit from the original production will not be refunded and may result in a percentage invoice applied to the abandoned production. 

 

 

30. Payment Policy

A 30% non-refundable deposit is payable on acceptance of the quote. No work or concepts will be started or delivered until the deposit payment has cleared. Progress payment of 20% is due at client review. Balance is payable on completion or if the client does not respond with changes or supply media for Greer Films Pty Ltd to complete the project, within 14 days after any proof has been supplied, a final balance invoice will be then be issued and due within 7 days of invoice date.

 

31. Delivery of Final Product

Greer Films Pty Ltd requires payment in full before final delivery of product to client, unless other arrangements have been entered into.

 

32. Changes to Scripts - Extra time

If Greer Films Pty Ltd has been engaged to write or present the client with a draft script, then this will be at the required word count length to suit the finished video length quote, approved by the client. If however the client makes changes the script which increases the word-count therefore increasing production length and finished final video length, then Greer Films Pty Ltd has the right to charge for extra post production and editing time at a percentage rate equivalent to the cost per 15 seconds of the extra one minute rate ie: 1 x 60 second extra length video = $1200 +GST therefore 15 secs extra = $300 +GST.

 

33. Cancellation

If the Client wishes to cancel at any time after accepting a quote, any deposits paid to Greer Films Pty Ltd are not refundable. If no deposit has been paid and work has a commenced, then the client will be liable for at least 50% of the total amount. If more than 50% of work has commenced or if out of pocket expenses exceed 50%, further payments from client may be liable.

Production
Studio Shoot
STUDIO HIRE TERMS & CONDITIONS

1. Agreement
The Hirer is the person or party ultimately responsible for the payment of the hire fees set out in the Estimate (and/or as may be proposed by or amended with approval of, Greer Films Pty Ltd on the day of hire). The Hirer will be deemed to be aware of and have accepted these Studio Hire Terms & Conditions together with the hire fees upon any studio hire bookings and any studio items or equipment items hired at Greer Films Pty Ltd pursuant to the Terms & Conditions of Equipment Hire. It is the Hirer’s responsibility to make themselves aware of these Studio Hire Terms & Conditions and the Terms & Conditions of Equipment Hire. Upon confirmation by Greer Films Pty Ltd of a booking request and together with any accompanying Estimate or other commercial terms agreed between the parties, the Hirer agrees to be bound by these terms and conditions. The Hirer acknowledges and agrees that they are freely entering into a legally binding agreement with Greer Films Pty Ltd.

 

2. Bookings
The Hirer acknowledges and agrees that they have discussed studio hire requirements with Greer Films Pty Ltd and the desired inclusions have been chosen and an Estimate has been provided. The Hirer understands, accepts and is clear on what will be delivered by Greer Films Pty Ltd as part of this hire agreement. Greer Films Pty Ltd agrees to reserve the hire date of the Hirer’s choosing; subject to availability. In the event that there is more than one booking for the same date, the Hirer acknowledges that Greer Films Pty Ltd can accept and confirm bookings on a first come, first served basis; giving the ‘1st hold’ Hirer’s requested booking enough notice to make their decision to either confirm their booking for acceptance by Greer Films Pty Ltd or release their hold. The Hirer acknowledges and agrees that Greer Films Pty Ltd will only provide services as per requirements set out in the Estimate and/or otherwise expressly agreed in writing by Greer Films Pty Ltd. The Hirer acknowledges and agrees that it is their responsibility to notify Greer Films Pty Ltd of any requested change of details to the Estimate (such as schedules and other requirements). Greer Films Pty Ltd may accept or reject such requested changes in its sole discretion. Greer Films Pty Ltd cannot and will not at any time be held responsible for not providing services as stated in the Estimate if Greer Films Pty Ltd has not been notified of change of details requests in writing prior to hire. Requested changes may also incur additional costs depending on changes requested. A booking is deemed ‘confirmed’ once Greer Films Pty Ltd has released any third party ‘holds’ and confirmed in writing its acceptance of the Hirer’s booking request. Only ‘confirmed’ bookings will secure the studio/s for the hire date. The Hirer agrees that if the date of the studio hire requires to be changed, this will be subject to availability of the chosen dates and the prior written approval of Greer Films Pty Ltd. Once a booking is confirmed, cancellation fees will apply.

 

3. Studio Use & Overtime
Studio hire rates are based on the use of the studios as a ‘facility’ only. Should you require to photograph or film the studio as a ‘location’ this must be addressed prior to the booking as additional fees will apply).
 

 

Standard hire times are as follows:

White Studio
Day bookings: 9am-5pm – no additional equipment or professional included.
12hr bookings: 7am-7pm – no additional equipment or professional included.
Photography / Videography Professional 4hours: 9am-1pm or 1pm-5pm
Photography / Videography Professional 6hours: 9am-3pm or 11am-5pm

Blue Audio Studio

The above hire times are inclusive of bump in and bump out. Bumping in or bumping out outside of these hours will incur overtime fees. Any bookings made for a Saturday, Sunday or public holiday will incur a loading fee. The agreed hire period is as per the Estimate supplied to the Hirer (unless agreed post issue of the Estimate). If Greer Films Pty Ltd is required beyond the agreed hours of hire, overtime fees will apply.

 

4. Additional Items
Any additional items required for the Hirer’s photoshoot (including, but not limited to: cyclorama repaint, equipment hire, props, plinth hire, wall flat hire, set build, catering, etc.) requested on the day of booking (and as a result not included in the Estimate) will be added to the studio hire invoice.

 

5. Cancellations
Cancellation of a confirmed booking less than 72 hours from the booking date (or no-shows) will result in an invoice for 100% of the provided Estimate. Cancellation of a confirmed booking more than 72 hours from the booking date will result in an invoice for 50% of the provided Estimate.

 

6. Indemnity
The Hirer agrees to indemnify Greer Films Pty Ltd against any liability, loss, damage or expense, including legal fees on an ordinary basis, arising out of the negligent performance or non-performance of its obligations under this hire agreement.

 

7. Public Liability Insurance

The Hirer must ensure that all necessary public liability insurances and any other required insurances are in place and operative for all persons in the studio during the hours of hire to cover any events (including accidents, injuries or death). The Hirer acknowledges and agrees that in an unforeseen and/or force majeure event where the space is no longer available due to damage or other incidents, Greer Films Pty Ltd will not be responsible or liable in any way for any inconvenience/damages/penalties or other loss incurred by or in relation to the Hirer. Greer Films Pty Ltd will not be responsible for the loss or theft of any property of any person using the Greer Films Studio premises, nor for any property lost by couriers in transit to or from the Greer Films Studio. All reasonable care will be exercised by Greer Films in supervising the space; however, it is the Hirer’s responsibility to make appropriate arrangements to ensure their property is properly secure whilst using the Greer Films Studio. If the Hirer is leaving property at the Greer Films Studio, or in the equipment room overnight, the Hirer acknowledges and agrees that it does so at its own risk.

 

8. Damages & Cleaning
The Hirer is liable for any damage made to the fabric of the building, fixtures, fittings, furniture or appliances therein or equipment and other items hired throughout the duration of the booking; unless an employee of Greer Films Pty Ltd willfully and negligently causes such damage. To the extent permitted by law the Hirer agrees that Greer Films Pty Ltd will not be held responsible for any damage to Hirer property or any injury that occurs during studio hire, whether it be a direct or indirect consequence of the actions of Greer Films Pty Ltd or its affiliates. If any damage is made to the cyclorama by the Hirer (including by any children, adults or equipment present during the time of the booking), Greer Films Pty Ltd cannot be held responsible or liable for any injuries or damages. In the event of the cyclorama becoming damaged, the Hirer acknowledges and agrees that they are responsible for the repair or replacement of the structure.

 

9. Rubbish Removal
General cleaning is included in the studio hire rate; however, should specialist cleaning or repainting be required of any areas, if left unsatisfactory, a cleaning fee will be incurred and payable by the Hirer. The Hirer is responsible for the removal of any excess rubbish, cardboard, polystyrene or external props and sets, and for returning the space to the same condition that it was found in. If the bins provided do not allow for excess rubbish, then arrangements should be made to take it with you when the Hirer leaves the premises. Alternatively, Greer Films Pty Ltd can arrange for additional rubbish disposal for an additional fee based on the amount of rubbish.

 

10. Surveillance
The studio has 24/7 surveillance as part of safety and security. The Hirer accepts this as condition of hire. No footage is made publicly available unless in the event of a criminal act/offence whereby footage will be provided to police or insurance companies as required.

11. Minors on Set
Any babies or children in the space must be accompanied and supervised by an adult at all times. It is the Hirer’s responsibility to have all necessary child permits and required paperwork in place and approved prior to the date of hire.

 

12. Props, Property, Deliveries & Collections
Prior to the Hirer’s booking, Greer Films Pty Ltd must be notified of all deliveries and collections planned to and from Greer Films Studio. Subject to studio availability and access (and volume of delivery), some deliveries can be made to Greer Films Studio the day prior to the Hirer’s booking. Such deliveries must be pre-approved in writing in order for Greer Films to be able to accept the delivery. Otherwise, all deliveries are to be made on the day of the booking. All items must be removed from Greer Films Studio at the conclusion of the Hirer’s booking and within the booking time. In some instances, some items can be left behind for next day collection, however this must be approved in writing by Greer Films Studio prior to the Hirer’s booking. The Hirer must ensure that all such items are insured. No Hirer related items held or stored on Greer Films Studio premises are covered by any insurance whatsoever held by Greer Films Pty Ltd. Greer Films Pty Ltd reserves the right to dispose of any items left on the premises should the Hirer wish not to collect. A fee may be incurred for disposal; should this be required.

 

13. Sub Hire
Sub hire, paid or unpaid and including lending, is forbidden without the written consent of Greer Films Pty Ltd.

 

14. Equipment of Greer Films
The Hirer at all times must use the equipment of Greer Films in a skillful and proper manner, in accordance with the terms and conditions of Equipment Hire available in the ‘M on W Equipment Hire’ PDF.

15. Equipment Failure
If for any reason there is a breakdown or failure of photographic equipment caused by reasonable wear and tear, and not by the Hirer’s negligence or misuse or any other reason whatsoever, then a period of hire and/or fee reduction shall be determined upon inspection by Greer Films Pty Ltd.

 

16. Payment
The Hirer acknowledges and agrees that all invoices are payable in full within 7 days from the date of invoice. For clarity, the Hirer acknowledges and agrees that any damage incurred during studio hire will be at the Hirer’s expense and any costs incurred to repair damaged equipment or replace lost/broken equipment will be invoiced directly to the Hirer. If the Hirer does not wish to pay via direct bank transfer, credit card payment options are available.
